Terms of service

Version: 26 October 2026

This English version is provided for information only. The German version is legally binding.

1. Seller and scope

1.1. The seller and your contractual partner for all orders placed in the online shop at www.ebenthal-vital.com (the “Online Shop”) is

WBBK Handels GmbH
Phorusgasse 8/1/21, 1040 Vienna, Austria
Phone: +43 699 109 634 52
Email: hallo@ebenthal-vital.com
Company register number: FN 560054 i, Commercial Court of Vienna
VAT ID: ATU77074504

(“we”, “us” or the “Seller”).

1.2. These General Terms and Conditions (“Terms”) apply to all contracts for the purchase of products concluded via the Online Shop. The version in force at the time of the order applies.

1.3. Our offer is aimed at consumers within the meaning of section 1 of the Austrian Consumer Protection Act (KSchG) and Article 2(1) of the Consumer Rights Directive (“Customer”). If a business places an order, these Terms apply accordingly; provisions that expressly apply to consumers only (in particular the right of withdrawal) do not apply in that case. We object to any differing terms and conditions of businesses.

1.4. The language of the contract is German. We provide an English version of these Terms for information; in the event of any discrepancy, the German version prevails.

2. Customer account

2.1. You do not need a customer account to place an order. Customers may choose to create an account to view their orders and details. The information required for this is marked in the registration form.

2.2. Customers must keep their login details confidential and inform us if they suspect misuse. The customer account can be deleted at any time by emailing hallo@ebenthal-vital.com.

3. Conclusion of the contract

3.1. The presentation of products in the Online Shop is not a binding offer but an invitation to the Customer to place an order.

3.2. The ordering process consists of the following steps:

  • selecting products and adding them to the basket
  • entering contact, delivery and billing details
  • choosing the shipping and payment method
  • checking all details in the order summary; input errors can be corrected at any time before submitting the order using the back and edit functions
  • submitting the binding order by clicking the button “Order with obligation to pay” or “Pay now”

3.3. By submitting the order, the Customer makes a binding offer to purchase the products in the basket. We confirm receipt of the order by email without delay (“order confirmation”). The order confirmation only confirms receipt and does not yet constitute acceptance of the offer.

3.4. The contract is concluded when we accept the offer. Acceptance takes place through whichever of the following occurs first:

  • sending a separate order acceptance or shipping confirmation by email,
  • dispatching the goods to the Customer, or
  • the purchase price being charged or debited by the selected payment provider.

If we are unable to accept an order (for example because a product is unavailable), we will inform the Customer without delay and refund any payments already made.

3.5. We store the text of the contract. We send the order details to the Customer by email with the order confirmation; these Terms and the cancellation policy with the model withdrawal form are attached to this email as PDF files. These texts are also available in the Online Shop at all times and can be saved and printed. Customers with an account can view their orders there.

3.6. The Customer is responsible for ensuring that their details, in particular their email address and delivery address, are correct and complete.

4. Prices and shipping costs

4.1. All prices are stated in euros and include statutory VAT. For deliveries to other EU countries, the VAT of the country of destination is charged; the final price shown in the basket applies.

4.2. Shipping costs are charged in addition unless free shipping is expressly stated. Shipping costs and free-shipping thresholds are listed on the “Shipping and payment” page and are shown in the basket and at checkout before the order is submitted.

5. Payment

5.1. The payment methods shown at checkout are available. These currently include credit and debit card (Visa, Mastercard, American Express, Maestro, UnionPay), Apple Pay, Google Pay and Shop Pay (processed via Shopify Payments), PayPal and Klarna, as well as further local payment methods depending on the delivery country (e.g. EPS bank transfer, MobilePay, Bizum, Satispay). The payment methods offered may depend on the delivery country, the order value and the device.

5.2. The purchase price is due when the contract is concluded. Payment is usually charged by the relevant payment provider immediately after the order is submitted. If you pay with PayPal, the terms of PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg also apply. If you pay with Klarna, the terms of Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden also apply; when paying by invoice or in instalments, the Customer pays Klarna.

5.3. The Customer receives the invoice electronically, usually as a download link in the shipping confirmation, and agrees to electronic invoicing. If an order that has already been shipped is cancelled or fully or partly refunded, the Customer receives a credit note, usually as a download link in the email about the cancellation or refund. A download link is valid for one year; after that, the Customer can request a new link via the same link.

6. Delivery

6.1. We only deliver by post or courier to delivery addresses in Austria, Germany, Denmark, Finland, France, Ireland, Italy, the Netherlands, Sweden, Slovakia, Slovenia, Spain, the Czech Republic and Hungary. Collection in person is not possible.

6.2. Depending on the delivery country, goods are shipped from our warehouse in Vienna or by a contracted logistics provider from a warehouse within the EU.

6.3. The delivery time is stated for each product or on the “Shipping and payment” page. If no time is stated, we deliver within 30 days of the conclusion of the contract at the latest.

6.4. If a delivery date cannot be met for reasons beyond our control (e.g. force majeure, strikes, disruptions at the carrier), the delivery period is extended by a reasonable amount of time. We will inform the Customer as soon as possible.

6.5. If we do not deliver on time, the Customer may set us a reasonable additional period. If we still fail to deliver within that period, the Customer may withdraw from the contract. We will refund any payments already made without delay.

6.6. The risk of loss of or damage to the goods only passes to the Customer when the goods are delivered to them or to a third party designated by them other than the carrier.

7. Retention of title

The goods remain our property until the purchase price, including shipping costs, has been paid in full.

8. Right of withdrawal

8.1. Consumers have a statutory right of withdrawal of 14 days. Details, exceptions and the model withdrawal form are set out in the cancellation policy, which forms part of these Terms.

8.2. Withdrawal can also be declared online via the “Withdraw from contract” button, which is available on every page of the Online Shop throughout the withdrawal period.

8.3. Our products are hygiene products and are delivered sealed. The right of withdrawal does not apply if the seal has been removed after delivery (see cancellation policy).

9. Statutory warranty

9.1. The statutory warranty applies, in particular under the Austrian Consumer Warranty Act (VGG) or the mandatory provisions of the country in which the Customer is habitually resident.

9.2. Defects can be reported to hallo@ebenthal-vital.com. Where reasonable for the Customer, they will send the defective goods to us after consulting us; in this case we bear the costs and risk of the return.

9.3. Please report any obvious transport damage to the delivery company as soon as possible and let us know. Failing to do so has no effect on your statutory warranty rights, but it helps us assert our own claims against the carrier.

9.4. Please observe the user manual supplied with each product.

10. Liability

10.1. We are liable without limitation for intent and gross negligence, for personal injury (injury to life, body or health) and under product liability law.

10.2. In cases of slight negligence, we are only liable for breaches of essential contractual obligations, i.e. obligations whose fulfilment is essential for the proper performance of the contract and on which the Customer may rely. In this case, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

10.3. Otherwise, liability for slight negligence is excluded. Mandatory statutory provisions remain unaffected.

11. Complaints and dispute resolution

11.1. You can send complaints to hallo@ebenthal-vital.com at any time. We will endeavour to find a quick, amicable solution.

11.2. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

12.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they are habitually resident.

12.2. For consumers, the statutory place of jurisdiction applies. For businesses, the place of jurisdiction is the competent court in Vienna.

12.3. The Customer will inform us of any change to their address or email address until the contract has been fully performed. If they fail to do so, statements we send to the last address provided are deemed to have been received.

12.4. Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.

12.5. We may amend these Terms for future orders. For a contract already concluded, the version in force at the time of the order applies.
